AUTONEXX SA — RETURNS, REFUNDS & EXCHANGES POLICY

Thank you for shopping with Autonexx SA.
We want every customer to have confidence when purchasing from us. This Returns, Refunds & Exchanges Policy applies to purchases made through the Autonexx SA online store and is intended to operate in accordance with applicable South African consumer-protection legislation, including the Consumer Protection Act 68 of 2008 (CPA) and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
Nothing in this policy is intended to exclude, restrict or waive any right that a consumer has under applicable South African law.
OUR COMMITMENT TO YOU
Autonexx SA is committed to supplying products that are of acceptable quality, in good working order, free from defects, and reasonably suitable for their intended purpose, subject to the requirements and limitations of applicable law.
If you experience a problem with your order, please contact us as soon as reasonably possible so that we can investigate the matter and provide an appropriate remedy.
CHANGE-OF-MIND RETURNS
If you simply change your mind about a purchase, Autonexx SA may accept a return where the product is:

unused;
-
undamaged;
-
in its original condition;
-
in its original packaging where reasonably possible;
-
accompanied by all accessories, manuals, cables and other items supplied with the product; and
-
accompanied by reasonable proof of purchase.
For voluntary change-of-mind returns that are not required by South African law, Autonexx SA may require the customer to pay the reasonable cost of returning the product to us.
A change-of-mind return does not affect any statutory right the consumer may have under South African law.
YOUR STATUTORY RIGHTS FOR DEFECTIVE GOODS
Under section 56 of the Consumer Protection Act, qualifying goods carry an implied warranty of quality.
Where goods fail to satisfy the applicable requirements and standards contemplated by the CPA within six months after delivery, a consumer may be entitled to return the goods to the supplier without penalty and at the supplier's risk and expense.
Subject to the CPA and the circumstances of the particular case, the consumer may be entitled to require:
• a repair;
• a replacement; or
• a refund.
The statutory rights described above are in addition to any other applicable warranty or consumer protection provided by law.
Autonexx SA will not use this policy to deprive a consumer of a remedy to which the consumer is legally entitled.
DEFECTIVE OR FAULTY PRODUCTS
If your Autonexx product develops a fault, please contact us with:

your order number;
-
your full name;
-
the date of purchase;
-
a description of the problem;
-
photographs or videos showing the issue where reasonably possible; and
-
any other information reasonably necessary for us to assess the problem.
We may request that the product be returned for inspection or testing.
Where the product qualifies for a statutory remedy under the CPA, Autonexx SA will provide the remedy required by applicable law.
A product will not ordinarily be considered defective merely because it has been damaged after delivery through misuse, negligence, accidental damage, unauthorised modification, incorrect installation, use contrary to supplied instructions, or ordinary wear and tear, subject always to the consumer's rights under applicable law.
5. PRODUCTS DAMAGED DURING DELIVERY
We take reasonable care when preparing orders for delivery.
If your product arrives visibly damaged, please contact us as soon as possible after receiving the parcel.
Where possible, please provide:

photographs of the outer packaging;

photographs of the damaged product;
-
your order number; and
-
a description of the damage.
We may need to investigate the matter with the relevant courier or delivery service.
Where the damage occurred before the product reached you and you are entitled to a remedy under applicable law, Autonexx SA will provide the applicable remedy.
INCORRECT PRODUCT RECEIVED
If we accidentally send you the wrong product, please contact us as soon as reasonably possible.
Once we have confirmed the error, Autonexx SA will arrange an appropriate remedy, which may include:

collection or return of the incorrect product at our expense;

delivery of the correct product; or
-
a refund where appropriate.
You should not be required to bear the cost of correcting an error caused by Autonexx SA.
MISSING ITEMS OR ACCESSORIES
If your order arrives with missing components, accessories or items that were included in the advertised product or your order, please notify us as soon as reasonably possible.
We may ask you to provide photographs of the package and its contents so that we can investigate.
Where an item was omitted from your order, Autonexx SA will work with you to provide the missing item or another appropriate remedy where required.
ONLINE PURCHASES AND COOLING-OFF RIGHTS
Certain electronic transactions may be subject to the cancellation rights contained in section 44 of the Electronic Communications and Transactions Act 25 of 2002.
Where a statutory cooling-off right applies to your transaction, you may exercise that right in accordance with the applicable legislation.
This statutory right is separate from our voluntary change-of-mind return policy.
Where a consumer validly exercises a statutory cooling-off right, Autonexx SA will process the cancellation and refund in accordance with the applicable legal requirements.

Please do not send a product back without first obtaining return instructions from Autonexx SA.
We may provide you with a return reference number or other instructions that must be followed when sending the product back.
RETURN CONDITION
Where a return is permitted on a voluntary change-of-mind basis, the product should be returned:

unused;
-
undamaged;
-
with all original accessories;
-
with manuals and other included materials;
-
in its original packaging where reasonably possible; and
-
in a condition that allows the product to be reasonably inspected.
These conditions do not override a consumer's statutory rights in relation to defective, unsafe, incorrectly supplied or otherwise non-conforming goods.
RETURN SHIPPING COSTS
The party responsible for return shipping costs depends on the reason for the return and the applicable law.
Defective, faulty or incorrectly supplied products
Where applicable law requires Autonexx SA to bear the return cost, Autonexx SA will do so.
Change-of-mind returns
Where the return is purely voluntary and is not required by law, the customer may be responsible for the reasonable cost of returning the product.
Autonexx SA will communicate the applicable return arrangements before the product is returned.
REFUNDS
Where a refund is approved, Autonexx SA will generally process the refund using the original payment method used for the transaction, where reasonably possible.
The time taken for the funds to appear in your account may depend on your bank, card issuer, payment provider or other financial institution.
Where South African law prescribes a particular refund period or procedure, the applicable legal requirement will apply.
REPAIRS AND REPLACEMENTS
Where a product qualifies for a repair or replacement under applicable law, Autonexx SA may inspect or test the product before providing the appropriate remedy.
Where a replacement is provided, the replacement product will be subject to the applicable statutory rights and any applicable manufacturer or supplier warranty.
Where a repair is performed, applicable statutory rights relating to subsequent failures or defects remain unaffected.
PRODUCTS DAMAGED THROUGH MISUSE
A return or refund may not be available where a product has been damaged as a result of circumstances for which Autonexx SA is not responsible, including, where applicable:

misuse;
-
accidental damage after delivery;
-
improper installation;
-
failure to follow operating instructions;
-
unauthorised modification or repair;
-
use for a purpose for which the product was not designed;
-
physical damage caused by the customer; or
-
normal wear and tear.
This section does not limit any statutory consumer right that cannot lawfully be excluded.
AUTOMOTIVE PRODUCTS AND SAFETY
Autonexx products may include automotive electrical equipment, portable power equipment, tyre inflation equipment and other vehicle-related accessories.
Customers are responsible for using products in accordance with the manufacturer's instructions and applicable safety warnings.
In particular, customers should not modify, disassemble or attempt unauthorised repairs to electrical or automotive products.
For products such as jump starters, compressors and electrical accessories, customers should carefully follow the supplied operating instructions and ensure that the product is suitable for the intended vehicle or application.
Nothing in this section limits any legal right relating to defective or unsafe goods.
SALE ITEMS AND PROMOTIONAL PRODUCTS
Discounted or promotional products remain subject to applicable South African consumer-protection legislation.
A product being sold at a discounted price does not automatically remove a consumer's statutory rights in relation to defects or other matters covered by applicable law.
Where a particular limitation or condition applies to a promotional product, it will be disclosed to the consumer before purchase to the extent required by law.

FRAUDULENT OR ABUSIVE RETURN REQUESTS
Autonexx SA reserves the right to investigate return requests where there are reasonable grounds to suspect fraud, abuse, intentional damage, false claims or misuse of the returns process.
Any investigation will be conducted subject to applicable South African law and will not affect legitimate statutory consumer rights.
CHANGES TO THIS POLICY
Autonexx SA may update this Returns, Refunds & Exchanges Policy from time to time.
The version published on this website will apply to transactions subject to applicable law.
Changes to this policy will not retrospectively remove rights that a consumer has already acquired under applicable legislation.
GOVERNING LAW
This policy and transactions made through the Autonexx SA online store are governed by the laws of the Republic of South Africa, subject to any mandatory rights and protections available to consumers under applicable legislation.
Nothing in this policy is intended to exclude or restrict any consumer protection that cannot lawfully be excluded or restricted.
